Today at 1:30pm, Brandy Devine, 25 of Turlock, was charged with two felony charges and one misdemeanor charge for the death of her two year old daughter, Stephanie Torres. Devine was charged with one felony count of murder (Penal Code 187a), one felony count for causing and permitting a child to suffer physical and mental suffering and placing a child in a dangerous situation without taking steps to protect the child (Penal Code 273a), and a misdemeanor count for the use of a controlled substance (Healthy & Safety Code 11550a), methamphetamine. Devine’s bail amount was set to $1 million.
During the arraignment, held at the Stanislaus County Superior Court in Modesto, Devine pleaded not guilty to the charges. At this point, investigators have not reported whether or not Child Protective Services had been involved with the case prior to the death of Torres.
Although an autopsy was performed on the 2 year old girl, the cause of death has yet to be released by officials.
Defense Attorney Marcus Mumford is leading the defense for Devine against Deputy District Attorney John Mayne. Judge Dawna Reeves will be presiding the PEOPLE vs. Brandy Lee Rose Devine Case.
“At this point we don’t have all the discovery that we will have,” stated Mayne during the arraignment.
The case has been scheduled for a Pretrial Hearing on September 7th, 2012 at 8:30am. The hearing will take place in Department 1 of the Superior Court of California of Stanislaus, located at 800 11th Street, Second Floor, in Modesto.
On Monday, at approximately 12:35pm, Turlock Police Department (TPD) Officers responded to the 1100 block of N. Denair to assist Emergency Medical Services personnel after receiving a 9-1-1 call from a neighbor of a non-responsive child.
TPD Officer’s arrived at the residence where they located a two year old female deceased. The mother, Brandy Devine, 25 years-old, was later interviewed by investigators and was subsequently arrested for crimes related to the death of the child. Devine was charged with homicide and other related child abuse charges. Devine was booked into the Stanislaus County Jail without bail.
Devine, the deceased child, and three other siblings lived in the home.
