Drunk driver with child and several warrants arrested after getting vehicle stuck on railroad tracks Friday night

On Friday, December 9th, 2022, at 11:59 pm, a Turlock Police officer near the intersection of N Front St and Almond Ave, Turlock, came up on a disabled vehicle stuck on the railroad tracks.

The officer made contact with the vehicle’s driver who identified himself as Cody Costa, 37, of Brisbane.

Other officers who heard about the disabled vehicle spotted a train heading into town which they were able to successfully stop prior to it arriving at and colliding with the vehicle.

Back at the disabled vehicle, officers noticed that Costa was exhibiting objective symptoms of being under the influence.

Eventually, based on the totality of the circumstances, officers determined that Costa was under the influence of alcohol.

Costa also had his child with him and was determined to have five bench warrants. The first one was a $50,500 one out of Stanislaus County for bringing or sending a controlled substance or paraphernalia for such into a jail or prison and bringing or sending an alcoholic beverage or non-controlled substance or paraphernalia for such into a jail or prison, the second one was a no-bail one out of Turlock for violation of a provision of law proscribing theft, embezzlement, forgery, fraud, or identity theft against an elder or dependant adult by a non-caretaker, the third one was a $100,555 one out of Turlock for battery, the fourth one was a $50,000 one out of Merced County for possession of ammunition by a prohibited person, and the fifth one was a $5,000 one out of Merced for possession of drug paraphernalia.

Costa was arrested and booked into the Stanislaus County Public Safety Center on charges of child abuse or endangerment under circumstances likely to produce great bodily harm or death, driving under the influence of alcohol, and driving with a blood alcohol content of .08 or greater, as well as his warrants.
