Drunk driver with child arrested early Sunday morning

On Sunday, May 7th, 2023, at 12:30 am, a Turlock Police officer near Paul’s Glass Co., 240 S First St, Turlock, observed a man driving a vehicle violate the California Vehicle Code, so he made a traffic stop on him.

The officer made contact with and identified the vehicle’s two occupants, Philip Baria, 38, of Hornitos, and his young son.

When the officer had his dispatcher run Baria, he discovered that he had a suspended driver’s license due to not paying child support.

While speaking with Baria, the officer noticed that he was displaying objective symptoms of being under the influence, so he removed him from his vehicle and asked him if he’d be willing to participate in standardized field sobriety tests. Baria agreed and completed two of the tests, however, was unable to complete the third.

Based on the totality of the circumstances, the officer determined that Baria was under the influence of alcohol.

Baria was arrested and provided two breath samples at the scene as required by California’s implied consent law. The breath samples revealed that Baria had a blood alcohol content of .08% or greater.

Baria was booked into the Stanislaus County Public Safety Center on charges of driving under the influence of alcohol, driving with a blood alcohol content of .08% or greater, child abuse or endangerment under circumstances other than those likely to produce great bodily harm or death, and driving with a suspended driver’s license. He was also issued an administrative driver’s license suspension order by the California Department of Motor Vehicles and his vehicle was impounded.

Baria’s son was picked up by family members who lived in the area.
