At about 12:10am Wednesday morning, Turlock Police responded to a battery in progress at the Applebee’s in the 2500 block of Fulkerth Road, after a customer had shoved an employee.

While officers were responding, the caller reported that the involved parties were leaving the area and provided a vehicle description.

Officer Nwando arrived in the area and spotted the involved vehicle leaving the parking lot, stopping it on Fulkerth Road right in front of the business.

Four subjects were contacted in the vehicle, including driver Roberto Cornejo, 36, of Turlock.

Through the investigation, it was determined that a different subject, who was not in the vehicle, was responsible for the assault. The occupants of the vehicle stated that they attempted to calm the subject down before the assault, however, were unsuccessful in their efforts. They then stated that he had taken off on foot and pointed towards a nearby field.

Sergeant Hernandez located the subject hiding in the field and attempted to detain him. He resisted, however, the resistance was quickly overcome and he was able to be placed in handcuffs. He was identified as Juan Gallegos, 37, of Delhi.

Gallegos was checked out by American Medical Response, however, didn’t require any assistance from them.

Gallegos was arrested for resisting and transported across the street to the business, where the victim was able to positively identify him and sign a citizen’s arrest.

Gallegos was booked into the Stanislaus County Public Safety Center on charges of resisting a peace officer, battery, and public intoxication.

Additionally, Cornejo was arrested for driving under the influence. He was issued a driver’s license suspension order and was released on a citation to a sober friend who came and picked him up.

The other three subjects had all been cooperative and hadn’t committed any crimes, so they were released.
